Terms of Service
Effective from 1 March 2026
1. General Terms
These Terms of Service govern your access to and use of the CargoM8.dev platform, operated by Mick Baruffato under the brand MickMind. By creating an account or using the platform, you agree to be bound by these Terms. CargoM8.dev is a transport management platform that connects carriers, freight forwarders, and drivers for logistics operations.
2. Accounts and User Responsibility
You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years of age. You may not use the platform for illegal purposes, attempt unauthorized access, upload malicious code, scrape data without authorization, or impersonate another person or entity.
3. Subscription and Payment
The platform offers tiered subscription plans. Payments are processed through Stripe. All prices are stated in DKK and are exclusive of VAT (moms) unless otherwise stated. Subscriptions are billed monthly or annually depending on the plan selected. You may upgrade or downgrade at any time; changes take effect at the next billing cycle. Refunds are not provided for partial billing periods except as required by law. We reserve the right to change pricing with 30 days' written notice.
4. Intellectual Property
The platform, including all software, design, branding, logos, and content, is the exclusive property of Mick Baruffato (MickMind) and is protected by Danish and international intellectual property laws. You retain ownership of content you upload. By uploading content, you grant us a limited, non-exclusive license to store, process, and display it solely for providing the service. You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the platform.
5. User Data vs Platform Data
Data you provide or generate through the platform (transport jobs, bids, documents, messages) remains your property. You may export your data at any time. Aggregated, anonymized data derived from platform usage (market trends, route statistics) is the property of MickMind and may be used to improve the service. We will never sell your personal data to third parties.
6. Service Availability
We strive to maintain high uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our reasonable control, including internet outages, third-party service failures, or force majeure events.
7. Limitation of Liability
CargoM8.dev is an intermediary platform. We are NOT a party to any transport agreement between users. We are not responsible for the quality, safety, legality, or timeliness of transport services, the accuracy of information provided by other users, or disputes between users. Our total aggregate liability shall not exceed the subscription fees paid in the 12 months preceding the claim.
8. Termination
You may terminate your account at any time through account settings. Upon termination, your access ceases at the end of the current billing period. We will retain your data for 30 days, after which it is permanently deleted. You may request data export before termination. We may suspend or terminate accounts that violate these Terms, with or without notice.
9. Governing Law and Disputes
These Terms are governed by Danish law. Disputes shall first be attempted resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the City Court of Copenhagen (Kobenhavns Byret). EU consumers may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.
